DMCA Policy for Knicks News

Knicks News (“we,” “us,” “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy to address claims of copyright infringement.

1. Reporting a Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any content on our website (knicksnews.net) infringes upon your copyrights, you may submit a notification pursuant to the DMCA. To be effective, the notification must be a written communication that includes the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the material is located).
  4. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notification, we will take whatever action we deem appropriate, including the removal of the challenged material from our website.

2. Submitting a Counter-Notification

If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be effective, a counter-notification must be a written communication that includes the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Knicks News may be found), and that you will accept service of process from the person who provided the original copyright infringement notification or an agent of such person.

If we receive a valid counter-notification, we may, in our discretion, send a copy to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Knicks News has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
